In the previous article, we explained what a municipal general plan is. Now, we will guide you step by step on how to submit an application regarding this document.
1. When Should You Submit an Application for the Municipal General Plan?
It is worth submitting an application when the municipality starts drafting or updating its general plan. As a property owner, developer, or investor, you have the right to propose changes to the plan, such as including your property in specific zones or defining future land use and building conditions.
2. The Application Form for the Municipal General Plan
The application must be submitted using a specific form – the Spatial Planning Act Submission Form, which is typically available on the official website of the municipality. Only applications submitted in this format will be considered.
3. Key Sections of the Application Form
The application form consists of several sections, but Section 7 is particularly important, as you must clearly define your expectations regarding the general plan. You need to specify:
- Planning Zone – defines the type of planned development or land use.
- Functional Profile – indicates the intended function of the property (e.g., residential, commercial).
- Building Parameters:
– Maximum building coverage ratio (Section 7.3.5 of the form).
– Maximum building height (Section 7.3.6 of the form).
– Minimum biologically active area, which must be at least 30% (Section 7.3.7 of the form).
– Above-ground development intensity (Section 7.2.4 of the form).
If your property is located in a densely built-up area, you may indicate whether it belongs to a central urban area or an infill development area.
4. How to Submit the Application?
You can submit the application in several ways:
- Paper form: In person at the municipal office or by mail to the municipality’s address.
- Electronic form: By email to the address provided by the municipality or via the ePUAP platform.
When submitting by mail, remember that the date of receipt by the municipal office matters, not the mailing date.
5. Application Deadlines
It is crucial to submit the application before the deadline set by the municipality. Late applications will not be considered, so ensure that your document is delivered on time.
You can also influence the content of the municipal general plan during public consultations, which take place after the draft plan is prepared. These consultations may include meetings, surveys, consultation points, or expert sessions. The exact forms of consultation are outlined in Article 8i of the Spatial Planning and Development Act.
